1. Agreement to these terms
By using this website, creating an account, or ordering services, you accept these Terms of Service and the policies linked here — notably the Acceptable use policy, Privacy policy, and Refund & cancellation policy.
We may change terms with reasonable notice. Material changes to paid services are communicated by email or through the client area. Continued use after changes are posted constitutes acceptance, except where a stricter process is required by law.
2. Services and acceptable use
HostStack provides web hosting (shared and cloud) and virtual private servers as described in your order, plan pages, and product descriptions at checkout.
You must not use the services in ways that violate the AUP, applicable Indian law, export controls, or third-party rights. We may suspend, throttle, or terminate accounts that endanger the network, send unsolicited bulk email, or host illegal, fraudulent, hateful, or non-consensual content.
3. Your account, password, and data
You are responsible for maintaining the confidentiality of credentials and for all actions taken through your account. You are also responsible for keeping your own off-site backups of critical data, even when the plan includes server-side backups.
You grant HostStack a limited licence to host, copy, and process your data solely to perform the service and as described in the Privacy policy. You must provide accurate contact information — we use it for security alerts, legal notices, and service updates that affect billing or availability.
4. Payment, renewals, and taxes in India
Fees are in INR unless stated otherwise, plus applicable GST. Promotional prices, where offered, are limited to the period shown.
Services renew on the published cycle (monthly, annual, etc.) at the then-current renewal rate unless you cancel in advance through the client area. You authorise us and our payment partners to charge your selected method for renewals until you cancel.
Failure to pay may lead to suspension or data deletion after a reasonable grace period specified in the service description. New shared hosting accounts are covered by our 30-day money-back guarantee.
5. Warranties and limitations
Services are provided on an "as is" and "as available" basis to the maximum extent allowed by law. We target 99.9% availability in line with the broader industry, but the internet and third parties are not fully under our control.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or lost-profit damages, or for your reliance on the service for life-safety, medical, or other ultra-high-stakes use cases not intended for general-purpose shared hosting. Your exclusive remedy is described in the refund policy, or a service credit we will specify in writing for eligible outages.
6. Governing law & formal dispute resolution
These Terms are governed by and construed in accordance with the laws of the Republic of India, without regard to its conflict-of-law provisions. The courts of Kolkata, West Bengal shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or our services.

Step 2 — Grievance Officer escalation
If your complaint is not resolved informally within 15 business days, you may escalate it in writing to our Grievance Officer at hoststackpro@gmail.com. We will acknowledge within 24 hours and aim to resolve within 15 days, as required by the IT (Intermediary Guidelines) Rules, 2011. See the full Grievance Officer page.
Step 3 — Legal proceedings
If the dispute cannot be resolved through the above steps, either party may initiate legal proceedings exclusively in the competent courts at Kolkata, West Bengal. Both parties waive any objection to jurisdiction or venue in those courts.

7. Prohibited uses in plain language
You must not:
- Resell, sublicense, or rent the control panel in ways that breach our licence.
- Reverse-engineer the management layer or map our internal network in ways that create risk.
- Attempt to access other customers' accounts or data on shared hardware.
- Bypass authentication to our or third-party systems.
- Mine cryptocurrency in ways disallowed by the AUP.
If you are unsure whether a use case (crypto nodes, public proxies, mass mailing) is allowed, ask before you build on production plans.
8. Copyright & intellectual property (DMCA-equivalent)
HostStack respects intellectual property rights and expects customers to do the same. Our procedures comply with the IT Act, 2000 (as intermediary) and follow practices equivalent to the DMCA for international copyright holders.
To submit a copyright infringement notice:
Send a written notice to hoststackpro@gmail.com or hoststackpro@gmail.com containing:
- Your full legal name, address, telephone number, and email address.
- A description of the copyrighted work you claim has been infringed.
- The URL(s) of the allegedly infringing material on our servers.
- A statement that you have a good faith belief the use is not authorised by the copyright owner, its agent, or law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are authorised to act on behalf of the copyright owner.
- Your physical or electronic signature.
Our counter-notice process:
If your content was removed in error, you may submit a counter-notice to hoststackpro@gmail.com stating: (a) your contact details; (b) identification of the removed material; (c) a statement under penalty of perjury that removal was by mistake or misidentification; (d) your consent to jurisdiction of courts at Kolkata.
Upon receipt of a valid notice, we will: (1) promptly notify the customer; (2) restrict access to the material if the notice is facially complete; and (3) restore material if a valid counter-notice is received and the complainant does not initiate legal proceedings within a reasonable period. Filing a false report may constitute perjury and may expose you to civil and criminal liability under Indian law.
